Zoning & Land Use

We have extensive experience with many zoning and land use matters including purchase and sale contracts (See Real Estate Transactions Tab), subdivision developments and site plans, building and use permits, leases, special exceptions/conditional uses and variances, riparian rights matters, easements of all types, alternative energy (including solar) projects and various agricultural and marina matters.

We have represented land owners, tenants and developers as well as neighbors and citizens with respect to projects about which they are concerned.

Our representation of developers has included residential, commercial and industrial projects. We also have experience assisting either party to landlord – tenant and contract disputes.

We have been involved with many land and historic structure preservation projects, including conservation easements and public funding for easement acquisitions.

We are experienced with the creation, organization and management of condominium regimes.

We advocate for our clients by addressing all such matters before the appropriate federal, state and local agencies including planning commissions, board of appeals and other governmental bodies.

This includes judicial appellate reviews at the Circuit Court, Maryland Court of Special Appeals and Maryland Court of Appeals levels.

Among other appellate cases, Phil Hoon has participated in land use cases before the Maryland Court of Appeals including Miller v. Pinto, 305 Md. 396, (1986); Dean v. Pinder, 312 Md. 154, (1988); Grasslands Plantation, Inc. v. Frizz King LLC, 410 Md. 191, (2009); and Litz v. Maryland Department of the Environment., No. 23, September Term 2015.
